Waterballoon Battle(tm) is constantly seeking ways to improve the specification; design and production of its products, therefore alterations and changes in shape, design, and form may take place from time to time, which does not constitute a breach of contract. While every effort is made to keep advertising materials, pictures, brochures, and web site up to date, pictures, images, or specifications may change at any time and should not be regarded as a guide to current specifications, nor do they constitute an offer for the sale of any particular item or piece of equipment.
2. Waterballoon Battletm if used improperly may be hazardous. End users must read, familiarize themselves, adhere to and comply with all safety rules, precautions, and procedures and must be responsible for informing players and bystanders as well.
3. Waterballoon Battletm is manufactured and sold for the intended use of adults and minors supervised by competent adults. Any use, other than the use described herein, including but not limited to unsupervised use by minors, improper or malicious use, etc. is done so by the voluntary discretion of the purchaser and by doing so indemnifies the manufacturers, sub-contractors, inventors, insurance company(s), distributors or resellers of any liability whatsoever.
4. The removal of the Lexan Shield or warning label affixed thereon or the non-compliance of such, which provides rules and instructions for the safe operation of Waterballoon Battletm, is strictly prohibited. Any removal of said warning label does not void the liability disclaimer or any part herein.
5. Any holes, slits, or other perforations made into the Shield, or substitution of the Shield by the use of any porous material such as screen, chain link fencing, etc for the purpose of increasing the splashing effect of a direct hit to the Launching Station is strictly prohibited as it is protected under a patent held by another water balloon game manufacturer. 5. Dealers and Distributors are not agents of Waterballoon Battle(tm) or Star-Walk Entertainment and have absolutely no authority to bind its owners, inventors, or any other person or entities involved with the production or manufacture of said products of any expressed or implied undertaking or representation.
6. We reserve the right to display our Trademarked Logo on all our products, it is strictly prohibited to remove or deface said trademarks and / or logos.
7. All pictures, drawings, descriptions, and literature whether printed or electronic are copyrighted and remain our property, and must not be reproduced in any manner without the express written consent of the manufacturer.
8. Using such copyrighted material, whether used with permission or not, the customer further binds themselves to indemnify us completely should it infringe the rights of any person.
9. Dealers and Distributors are not agents of Waterballoon Battle or Star-Walk Entertainment LLC, and have absolutely no authority to bind Waterballoon Battle, Star-Walk Entertainment LLC, its owners, inventors, or any other person or entities involved with the production or manufacture of said products of any expressed or implied undertaking or representation.
1. Due to the nature of plastic, the Safety Shield cannot be warranted against scratching, hazing, or discoloring and is therefore not warranted.
2. Powder Coating on all units is very durable, however misuse in handling by dropping, dragging, scraping, gouging or any other means is not warranted.
3. Due to the nature of steel, hinges and other non-powder coated metal parts including the inside of the tubing will ultimately start to rust even if properly protected and lubricated and therefore cannot be warranted.
4. Slingshots, including its handle, tubing, and pouch are considered a wear item and are excluded from all warrantees.
5. All other components carry a full 1-year warrantee from date of purchase to the original owner. This warranty gives you specific legal rights, and you may also have other rights, which vary from state to state.
6. Any return must have a Return Authorization Number and must be sent freight prepaid to the factory or the shipment will be refused and returned to sender.
7. If in the sole judgment of the factory, after inspection, abuse was deemed the cause of failure, the manufacturer reserves the right to void any such claim and return the product from whence it came, freight collect. If however the claim is valid, the manufacturer may at its sole discretion, repair, replace, or refund the original purchase price of said merchandise and will return the product, transportation charges prepaid if repairable or replaced, provided it was delivered prepaid to the manufacturer.
